Precision Paintworks – Terms and Conditions
GENERAL:
All service agreements and project bookings between Precision Paintworks ("Precision Paintworks") and the client ("Client") are subject to approval by Precision Paintworks. Any terms provided by the Client that conflict with the terms outlined herein are expressly rejected. These Terms and Conditions shall govern all work unless otherwise agreed to in writing by both parties.
PRICING AND PAYMENT:
All pricing is based on the scope of work provided at the time of estimate. Prices are subject to change if there are modifications to the original scope. Payment terms will be clearly outlined in the project proposal. A deposit may be required to secure scheduling, with the balance due upon completion unless otherwise agreed upon in writing.
Precision Paintworks reserves the right to adjust pricing due to changes in material costs, labor availability, or unforeseen site conditions. All material costs are the responsibility of the Client.
Accepted payment methods include cash, check, and major credit cards. A fee may be applied for returned checks or declined payments.
SCHEDULING AND AVAILABILITY:
While we strive to meet all scheduled start and completion dates, project timelines may be affected by weather, site conditions, or material delays. Precision Paintworks is not liable for any indirect or consequential damages caused by such delays.
Our standard operating hours are:

Monday to Friday: 8:00 AM – 5:00 PM

Saturday and Sunday: Closed
Requests for work outside of these hours may be accommodated on a case-by-case basis and may incur additional charges.

WARRANTY:
Precision Paintworks stands behind its workmanship. Interior painting and craftsmanship (e.g., drywall, finish carpentry, and flooring installations) are covered under a one-year limited warranty against peeling, blistering, or flaking due to improper preparation or application.
This warranty does not cover:

Normal wear and tear, abuse, or negligence

Damage caused by water intrusion, structural movement, mold, or external events

Work not performed by Precision Paintworks

Areas where Client opted out of recommended surface repairs or preparation
Warranty claims must be made in writing within the warranty period. If approved, Precision Paintworks will schedule a touch-up or repair at no cost. All warranty work will be performed during normal business hours.
CHANGES TO SCOPE:
Any changes or additions to the agreed-upon scope must be submitted in writing and approved by Precision Paintworks. Changes may impact project cost and schedule.
LIMITATION OF LIABILITY:
Precision Paintworks’ total liability for any claim related to its services is limited to the total amount paid by the Client for the specific service giving rise to the claim. Under no circumstance shall Precision Paintworks be liable for indirect, incidental, special, or consequential damages, including but not limited to lost profits or property damage not caused by our negligence.
MATERIALS AND SUPPLIERS:
Precision Paintworks uses high-quality materials from reputable suppliers. If the Client requests specific materials or brands, this must be communicated before the project begins and may affect pricing and scheduling.
CLIENT RESPONSIBILITIES:
The Client is responsible for:

Providing access to the work site during agreed-upon hours

Ensuring the work area is free from personal items and obstructions

Notifying Precision Paintworks of any restrictions or special requirements related to the property (e.g., security systems, pets, parking restrictions)
SHIPPING/MATERIAL DELIVERY:
When applicable, materials may be delivered directly to the job site or staged in advance. Clients must provide a safe, accessible location for deliveries. Precision Paintworks is not responsible for delays caused by supplier backorders or delivery issues.
USE OF NAME AND IMAGES:
Client grants Precision Paintworks the right to photograph completed work for marketing purposes. However, no Client name, address, or personal information will be disclosed without written consent. Clients may not use the Precision Paintworks name, logo, or brand in any public materials without prior written approval.
LEGAL FEES AND COLLECTIONS:
In the event Precision Paintworks must pursue collection of unpaid balances, the Client agrees to pay all legal fees, court costs, and interest permitted by law.
ENTIRE AGREEMENT:
These Terms, combined with any accepted proposal or signed work authorization, represent the full agreement between Precision Paintworks and the Client. Any amendments must be in writing and signed by both parties. No verbal agreements will be recognized.
GOVERNING LAW AND JURISDICTION:
These Terms and Conditions shall be governed by the laws of the State of Maryland. Any disputes shall be resolved in the appropriate courts located in Montgomery County, Maryland.
